1. Who we are and what these terms cover

These Terms of Service (the “Terms”) form a binding agreement between you and EL FAITAH LLC (“EL FAITAH LLC”, “we”, “us” or “our”), the company that operates moreDS, including the websites at moreds.com and app.moreds.com and every tool, feature and plan offered through them (together, the “Service”).

By creating an account, purchasing a plan or otherwise using the Service, you confirm that you have read and accept these Terms, our Privacy Policy, our Refund Policy and our Cookie Policy. If you do not agree, do not use the Service.

2. Eligibility and your account

• You must be at least 18 years old and able to form a binding contract to use the Service.
• If you use the Service on behalf of a business, you confirm that you are authorised to accept these Terms for it, and “you” includes that business.
• You must give accurate information when you register and keep it up to date.
• Each account is for one person. You may not share your login details or let others use your account.
• You are responsible for keeping your password secure and for all activity under your account. Tell us promptly at [email protected] if you believe your account has been accessed without permission.

3. The Service

moreDS provides online tools for researching e-commerce products, advertisements, stores and suppliers, including hand-picked products, an ads library, trending products, TikTok Shop analytics, Shopify store research and supplier lookup.

• Much of the information in the Service, such as product listings, prices, sales estimates, images, advertisements and store figures, comes from third-party sources. We present it as it is available to us and do not guarantee that it is complete, accurate or current.
• The Service is provided for research and informational purposes. It does not guarantee that any product, advertisement or supplier will produce sales or profit. Business decisions you make using the Service are your own.
• We may add, change or remove features, data sources or tools at any time, and some features may be available only on certain plans.

4. Plans, payments and access periods

• Paid plans, their features and their prices are shown on the Service before you buy. Prices are in U.S. dollars unless stated otherwise and do not include taxes, which are added where required.
• Payments are processed by our payment provider, Stripe. By purchasing, you authorise us, through Stripe, to charge your chosen payment method for the plan you select.
• Plans are one-time payments and do not renew automatically. Each payment gives you one month of access to the plan you choose, starting when the payment is confirmed. We will not charge you again unless you make a new purchase.
• To keep using a paid plan after your month ends, you can renew it by making another payment from your account. A renewal starts a new month on the day you pay; days left on a current month are not carried over. If you do not renew, access to paid features ends when the month ends; your account itself stays open.
• Free trials, free plans and promotional offers may be provided based on availability and are subject to change or withdrawal at any time. They never turn into a paid plan automatically.
• We may change plan prices. A change never affects a period you have already paid for; it applies to purchases made after it takes effect.
• If a payment is not completed, the plan is not activated.

5. Digital delivery

All moreDS products and plans are digital services. Nothing is shipped. Access to the features of your plan is provided through your account as soon as your payment is confirmed, and continues until the end of the one-month period you paid for.

6. Renewal and refunds

• There is no subscription to cancel. Your plan ends on its own at the end of the month you paid for, and you are never charged again unless you choose to renew.
• All payments are final and non-refundable. Because the Service is digital and made available immediately, we do not provide refunds or credits for partial periods, unused time or features, moving to a lower plan or accounts closed for breaching these Terms, except where the law requires otherwise or where we have charged you in error.

7. Acceptable use

You agree not to, and not to help anyone else to:

• copy, scrape, download in bulk, resell, redistribute or publish data from the Service, or use it to build a competing product or database;
• access the Service with bots, scrapers or other automated means, or in a way that places an unreasonable load on it;
• share, sell or transfer your account, or let anyone else use it;
• reverse engineer, decompile or try to extract the source code of the Service, or bypass any security or usage limit;
• use the Service for anything unlawful, fraudulent or infringing, or to sell counterfeit goods or products that infringe anyone’s intellectual property;
• upload malicious code or interfere with the Service or other users.

8. Third-party content and trademarks

Product names, descriptions, images, videos, advertisements and store information shown in the Service belong to their respective owners. The names and logos of marketplaces and platforms such as AliExpress, Amazon, eBay, Walmart, CJdropshipping, TikTok, Facebook and Shopify are trademarks of their owners and are used only to identify the source of information. EL FAITAH LLC is not affiliated with, endorsed by or sponsored by any of them.

The Service links to third-party websites. We are not responsible for their content, products or practices, and your dealings with any supplier, marketplace or seller are solely between you and them.

9. Our intellectual property

The Service, including its software, design, text, graphics, the moreDS name and logo, and the way information is selected and arranged, is owned by EL FAITAH LLC or its licensors and is protected by law. We grant you a limited, personal, non-exclusive, non-transferable and revocable right to use the Service for your own business research while these Terms are in effect. No other rights are granted.

If you send us feedback or suggestions, we may use them without any obligation to you.

10. Disclaimers

The Service is provided “as is” and “as available”. To the fullest extent permitted by law, EL FAITAH LLC disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not warrant that the Service will be uninterrupted or error-free, or that any information in it is accurate or complete. Nothing in the Service is financial, legal, tax or business advice.

11. Limitation of liability

To the fullest extent permitted by law, EL FAITAH LLC and its members, officers, employees and suppliers will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data, goodwill or business opportunity, arising from or related to your use of the Service.

Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us for the Service in the twelve months before the event giving rise to the claim, or one hundred U.S. dollars (US$100). Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

12. Indemnity

You agree to defend, indemnify and hold harmless EL FAITAH LLC and its members, officers and employees from any claims, losses and expenses, including reasonable legal fees, arising from your use of the Service, your breach of these Terms or your violation of any law or third-party right.

13. Suspension and termination

You may stop using the Service and close your account at any time. We may suspend or terminate your access, without refund, if you breach these Terms, if your payment fails or is disputed, or if we must do so to comply with the law or protect the Service or other users. Sections that by their nature should survive termination, including sections 6 and 8 to 15, will survive.

14. Payment disputes

If you believe you have been charged incorrectly, please contact us at [email protected] before disputing the charge with your bank, so we can look into it and correct any error. Filing a chargeback for a valid charge may result in your account being suspended.

15. Governing law and disputes

These Terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict-of-laws rules. Before starting any formal proceeding, you agree to contact us at [email protected] and try to resolve the dispute informally for at least thirty days. Nothing in this section limits any mandatory consumer protection rights you have under the laws of the country where you live.

16. Changes to these Terms

We may update these Terms from time to time. The date at the top shows when they last changed. If a change is material, we will give you reasonable notice, for example by email or in the Service. Continuing to use the Service after a change takes effect means you accept the updated Terms.

17. General

These Terms, together with the policies they refer to, are the entire agreement between you and EL FAITAH LLC about the Service. If any part is found unenforceable, the rest remains in effect. Our failure to enforce a right is not a waiver of it. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition or sale of assets. We are not liable for delays or failures caused by events beyond our reasonable control.
